Civil penalty unit rate increase

A new civil penalty unit rate is in place, effective 1 July 2020. Penalty units are defined by legislation under subsection 4AA(1A) of the Crimes Act 1914 (Cth) and are subject to change. The amount has changed to $222 per unit. The new rate applies to offences committed on or after 1 July 2020. See the announcement. Coal LSL has the power to seek civil penalties for unmet legal obligations up to the value of 300 penalty units. For example, for a late annual audit report, a company may incur a penalty of 40 penalty units for an individual or 200 penalty units for a body corporate for each year that this legislative requirement is not met.
